1. Exemption statement
PornVerdict is not a "producer", primary or secondary, of any visual content depicting actual or simulated sexually explicit conduct, within the meaning of 18 U.S.C. § 2257, 18 U.S.C. § 2257A and their implementing regulations at 28 C.F.R. Part 75. Accordingly, the record keeping and labelling requirements of those provisions do not apply to the operator of this website.
2. Why the exemption applies
- The operator does not film, photograph, create, digitise, upload, publish, host or stream any depiction of sexually explicit conduct.
- The site consists of written reviews, scores, rankings, logos and reduced screenshots of public homepages of third party websites, which we censor so that no sexually explicit conduct is visible.
- Providing hyperlinks to, or text describing, other websites is not production. Under 18 U.S.C. § 2257(h)(2)(B), the term "produces" does not include activities limited to mere distribution, any activity that does not involve hiring, contracting for, managing or otherwise arranging for the participation of the depicted performers, or the transmission, storage, retrieval, hosting or formatting of a communication without selection or alteration of its content.
- We do not hire, contract with, manage or arrange for the participation of any performer.
3. Third party websites
Every website reviewed or linked on PornVerdict is operated by an independent third party. The operators of those websites are solely responsible for complying with 18 U.S.C. § 2257, § 2257A, 28 C.F.R. Part 75 and any equivalent laws in their own countries, including keeping age and identity records for every performer and publishing the required custodian of records statement. Requests for records must be directed to the custodian of records named on the website where the content appears. PornVerdict does not hold any such records.
4. Zero tolerance for minors
We have zero tolerance for any depiction of minors in sexual content. We do not review or link to websites that we believe host child sexual abuse material, and if we become aware of it we report it to the National Center for Missing & Exploited Children (NCMEC) CyberTipline, the Internet Watch Foundation or the relevant national hotline. If you see such material anywhere, report it immediately at report.cybertip.org or through our Report & Content Removal page.
